1. Introduction & Acceptance of Terms
These Terms of Service and End User License Agreement ("Agreement") govern your access to and use of all mobile applications, casual games, and artificial intelligence software tools published by AronGame OU (including products published under our studio trade name Monga Apps), accessible via the Apple App Store, Google Play Store, or our website (collectively, the "Services").
By downloading, installing, accessing, or using any of our Services (including Pocket Cat: My Virtual Pet, InkForge: AI Tattoo Generator, Homly AI: Home & Garden Design, Kynora: Puppy & Dog Training, and companion tools), you expressly agree to be bound by this Agreement. If you do not agree to these terms, do not install or use our Services.
2. Limited License Grant
Subject to your compliance with this Agreement, AronGame OU grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, and use one copy of the application on your personal mobile device solely for personal, non-commercial entertainment, design, or utility purposes.
You agree not to copy, reverse-engineer, decompile, disassemble, attempt to derive the source code of, modify, or create derivative works of any part of the applications, updates, or any portion thereof.
3. In-App Purchases, Auto-Renewable Subscriptions & Payments
Our applications may offer digital content, premium feature tiers, and auto-renewable subscriptions through Apple In-App Purchases (StoreKit) and Google Play Billing.
- Billing Platform: Payment will be charged to your iTunes Account (iOS) or Google Play Account (Android) at confirmation of purchase. AronGame OU does not process, store, or have access to your payment card details.
- Auto-Renewal Terms: Subscriptions automatically renew for the same duration and price (e.g. weekly, monthly, annual) unless auto-renew is cancelled at least twenty-four (24) hours prior to the conclusion of the current subscription period.
- Account Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate specified at the time of your initial purchase or subsequent notified renewal.
- Free Trials: Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable.
- Subscription Management: You may manage or turn off auto-renewal at any time in your device Account Settings (iOS: Settings > Apple ID > Subscriptions; Android: Google Play > Payments & Subscriptions).
- Restoring Purchases: If you reinstall the app or change devices, you can restore active subscriptions or permanent non-consumable unlocks by tapping the "Restore Purchases" button inside the application settings.
4. Artificial Intelligence (AI) Features & User-Generated Content
For applications providing AI-assisted generation (e.g. InkForge Tattoo Generator, Homly AI):
- Prompt Responsibility: You are solely responsible for the prompts, text queries, and images you input into our AI generation tools. You represent that you own or hold sufficient rights to any input materials uploaded.
- Prohibited Conduct: You may not use our AI tools to generate illegal, hateful, sexually explicit, abusive, defamatory, or copyright-infringing imagery. AronGame OU deploys automated safety classifiers and reserves the right to ban accounts or block requests that violate safety standards.
- AI Output Disclaimers: Generative AI outputs are probabilistic and algorithmic in nature. AronGame OU does not warrant that AI-generated architectural layouts, home designs, or tattoo stencils are error-free or suitable for professional structural engineering, medical, or permanent bodily modification without independent human verification.
5. Virtual Goods and Game Currencies
In simulation and casual games (e.g. Pocket Cat), virtual items, coins, or customizable accessories represent a limited, non-refundable license. Virtual goods have no monetary value outside the application, cannot be redeemed for fiat currency, and may not be sold or transferred between players.
6. Intellectual Property Rights
All trademarks, service marks, trade names, logos (including the AronGame trademark), graphical assets, sound effects, animations, code, and interfaces are the exclusive property of AronGame OU or its licensors. All rights not expressly granted herein are reserved.
7. Disclaimer of Warranties & Limitation of Liability
The applications are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permissible under applicable Estonian and European Union consumer legislation, AronGame OU disclaims all liability for any indirect, incidental, special, or consequential damages resulting from your use or inability to use our applications.
8. Governing Law and Dispute Resolution
This Agreement is governed by and construed in accordance with the laws of the Republic of Estonia, excluding its conflict of law provisions. Any dispute arising out of or in connection with this Agreement shall be submitted to the competent courts of Tallinn, Estonia.
